Universal Terms of Service Agreement

PLEASE READ THIS UNIVERSAL TERMS OF SERVICE AGREEMENT CAREFULLY, AS IT CONTAINS IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS AND REMEDIES.
1. Overview
This Universal Terms of Service Agreement (this “Agreement”) is entered into by and between ROBERTS AARON LEE PERSOANĂ FIZICĂ AUTORIZATĂ (CUI: 41431477, Nr. matriculation: F12/1132/2019, EUID: ROONRC.F12/1132/2019), hereafter referred to as “ALR Network,” and you, and is made effective as of the date of your use of this website (“Site”) or the date of electronic acceptance.
This Agreement sets forth the general terms and conditions of your use of the Site and the products and services purchased or accessed through this Site (individually and collectively, the “Services”). It supplements any specific terms and conditions that apply to particular Services. Your use of this Site or the Services and your electronic acceptance of this Agreement signify that you have read, understand, acknowledge, and agree to be bound by this Agreement, including:
- Privacy Policy
- Acceptable Use Policy (AUP)
- Uniform Domain Name Dispute Resolution Policy (UDPR)
- Service Level Agreement (SLA)
- Refund Policy
The terms “we,” “us,” or “our” refer to ALR Network. The terms “you,” “your,” “User,” or “customer” refer to any individual or entity who accepts this Agreement or uses the Services. Nothing in this Agreement shall confer any third-party rights or benefits.
ALR Network may modify this Agreement and related policies at any time, effective immediately upon posting to this Site. Your continued use of this Site or the Services after changes are posted constitutes your acceptance of the updated Agreement. It is your responsibility to ensure that your Account information, including email address, is accurate and current. ALR Network assumes no responsibility for your failure to receive notifications.
2. Eligibility; Authority
You represent and warrant that:
- You are at least eighteen (18) years of age.
- You are capable of forming legally binding contracts under applicable law.
- You are not barred from purchasing or receiving the Services under the laws of Romania or any other applicable jurisdiction.
If you are acting on behalf of a corporate entity, you warrant that you have the authority to bind the entity to this Agreement. If ALR Network determines you lack this authority, you will be personally responsible for all obligations under this Agreement.
3. Accounts; Data Transfers
You must create an Account to access certain features of this Site or Services. You agree to provide accurate, current, and complete information and to update your Account as necessary. ALR Network reserves the right to suspend or terminate Accounts with false or outdated information.
You are responsible for all activity under your Account and must keep your login credentials secure. Notify ALR Network immediately if you suspect unauthorised access. ALR Network is not liable for losses incurred due to unauthorised use of your Account.
By using this Site, you consent to the transfer of your information (including Account information) across international boundaries, as applicable.
4. Backup Policy
ALR Network performs nightly backups for disaster recovery purposes. These encrypted backups are generated at 00:00 EET and stored securely in a geographically separate EU location. Backups contents include:
- Website Data
- Domains Directory: Backs up all user files for all domains
- Subdomains Lists: Backs up the list of subdomains for each domain
- E-mail
- E-mail Accounts List for all domains (names and passwords)
- E-mail Data: Includes the messages from the Inbox, IMAP Folders, and webmail data.
- E-mail Settings: Includes the filters and the catchall address.
- Forwarders: Includes all forwarding addresses.
- Autoresponders: Includes all autoresponders and messages.
- Vacation Messages: Includes all vacation messages and times.
- Mailing Lists: Includes all mailing lists.
- FTP
- FTP Accounts
- FTP Settings
- Database
- Database Settings: Backs up all DB Users and DB Settings
- File Server Contents
- Anything stored in your home directory
- Deleted Trash
Backups are retained for 90 days, after which they are securely deleted. Clients may request restoration of their data subject to the following:
- A restoration fee of €65.00 (+ applicable taxes).
- Data restoration is not guaranteed, and ALR Network disclaims liability for data loss during or after restoration.
Clients are strongly encouraged to maintain their own backups using hosting control panel tools or external solutions.
5. General Rules of Conduct
You agree to comply with applicable laws and regulations and avoid activities that:
- Infringe on the intellectual property rights of others.
- Violate privacy or confidentiality rights.
- Interfere with Site operations, including introducing malware or unauthorised software.
- Involve spam or other unsolicited communications.

6. Service Availability
ALR Network makes commercially reasonable efforts to ensure Service availability. However, temporary disruptions may occur due to maintenance, technical issues, or factors beyond our control. ALR Network is not liable for losses resulting from such disruptions.
12. Payments
This section outlines the terms and conditions related to payments for ALR Network services. By purchasing or using our services, you agree to the following:
(A) General Terms
- You agree to pay all prices and fees for services at the time of purchase, as specified during checkout or in your invoice. All payments are non-refundable unless explicitly stated in the Refund Policy.
- ALR Network reserves the right to change prices and fees at any time. New rates will apply to services purchased or renewed after such changes are posted.
- All fees must be paid using one of the supported payment methods: valid credit/debit cards, PayPal, bank transfer, or other approved methods listed during checkout.
- You are responsible for keeping your payment information accurate and up to date in your ALR Network Account.
- Any taxes, including VAT, imposed on the services will be added to your invoice and are payable by you.
- ALR Network invoice payments can be made via the ALR Network account or via the ALR Network Billing & Payments platform.
- All legal entities registered in Romania are required to complete their company profile and provide their CUI, otherwise invoices and payments will be recorded against the individual and not the business entity.
(B) Automatic Renewals
- Many services offered by ALR Network are set to automatically renew to prevent service interruptions. Automatic renewals will be charged to your default payment method at the then-current rates.
- You may disable automatic renewal at any time via your ALR Network Account. If you do not disable this option, ALR Network assumes no responsibility for any charges or renewals you did not intend to make.
- Failure to process payment for automatic renewal may result in service suspension or termination.
(C) Late Payments
- Invoices are due within 14 days of issuance unless otherwise specified in the invoice or notification email.
- Late payments are subject to a fee of 10% of the overdue amount. The late fee will be applied five (5) days after the invoice due date.
- Services may be suspended for non-payment after five (5) days and terminated after thirty (30) days of non-payment. ALR Network assumes no liability for data loss or service interruptions caused by such suspensions or terminations.
(D) Service Recovery Following Termination
- ALR Network retains backups for terminated services for 90 days from the termination date. Clients may request data restoration, subject to a €65.00 restoration fee (+ applicable taxes).
- Data restoration is not guaranteed, and ALR Network disclaims all liability for data loss during or after the recovery process.
(E) Refunds
Refund eligibility is governed by the Refund Policy. Refunds, if applicable, will be issued to the original payment method or as in-store credit at ALR Network’s sole discretion.
8. Monitoring and Account Termination
ALR Network reserves the right to monitor content hosted on its servers and terminate accounts that violate this Agreement or related policies. In the event of termination, data and files may be removed from our servers.
9. Governing Law
This Agreement is governed by the laws of Romania and the European Union. Disputes related to domain names are subject to the Uniform Domain Name Dispute Resolution Policy.

Uniform Domain Name Dispute Resolution Policy (UDRP)

Trademark / Copyright Infringement Policy
